Agreed, NO WAY should the tow driver be convicted of a crime. A crime requires EITHER intent, or reckless disregard as one of the elements. The tow driver is guilty (perhaps) of negligence, nothing more. Negligence constitutes a tort, not a crime....... Login to read more.
