Tried every test I could think of and then pulled a known good cluster out of a friends E36. The new cluster from the dealer is defective. The customer is taking it back in to be repaired under warranty. Thanks for all the help guys.

thanks to all who replied and for the helpful information,we did find that the cam position accuator was faulty the engine had nearly 200,000 miles on it and customer elected to enstall a low mile used engine.thanks again everyone Trouble codes: P1345 (cam/crank correlation).
