MIL Command Status: Fail

Hi guys, customer came in today because she failed NJ state inspection. The paperwork says it failed for MIL Command Status. There are no pending or history DTC's in the ECM and the I/M readiness status on the scantool shows MIL request off. There is one re-occuring DTC in the CVT/AT ecu for P0826 Mode switch malfunction, but this code should not cause the inspection to fail. She bought the car in August and has not been able to get it to pass, so there is no prior repair history. Has anyone ran into this problem? Any tips or advice on what the next step should be? Is there a possibilty that someone "tuned" this car and that is what is causing the problem? Thanks in advance. ~Sam
